Minutes of July 21, 2010 approved.

Silver (20-34)   Reid Silva noted that two pump-outs of the property had been required this year, and that the owner wished to up-grade, and requires an out-of-season observation hole and percolation test.  Mike Renahan noted that the Town observation well is dry;  while an out-of-season perc test can be approved, he asked that this be undertaken a little later in the season.  The Board noted that the pumpouts had not been pumped and transported with a permit issued by the BOH.  Marina Lent will write a letter to Jay Araujo regarding the practice of transporting septage without a permit.

Cohen/Scheuer (33-4, 6) The Board received a disposal works plan revision proposal from Reid Silva to change the proposed BioClere denitrification system to a FAST system.  

Lyons (30-116.2, 117, 118)  Reid Silva introduced a disposal works system permit application revision to add a tank and pump chamber for a new 2-bedroom guesthouse.  The Board noted that two fully-compliant systems are feasible on this property, asked Marina Lent to convey this to the ZBA, and approved  the proposed revision.

Mattox (13-9.17) The Board approved a permit for the emergency repair of a well casing which had cracked due to lightening.  The proposal submitted by John Clarke (Island Water Source) showed a new well ca. 5’ from the old one.  Separations are maintained as approved for the original well.

Fodor (18-49.1)   The Board reviewed a revision to a disposal works construction permit presented by George Sourati.  The plan involves a two-bedroom residence that will be tied into an existing leaching pit.  The plan had been previously approved by the Board, but changes in the house plans will require adjustment in tank location and lines.  The full plan for the lot involves a total of six bedrooms, but a second house has not yet been built.  The two-bedroom house under consideration in the revision before the board is larger than 800ft2.  The Board approved the revision to replace and move the location of the tank.

Chilmark Community Center PWS 4062006   Marina Lent presented the Sanitary Survey recently completed for the well.  Recommendations from the survey are to post emergency contact numbers in the Center, and to secure the well cap.  Marina has posted the numbers and will secure the well-cap.  She also reported on complaints received from the campers regarding a metallic taste in outdoor drinking fountains.   Following taste tests of the water in question pre- and post flushing, and consultation with DEP, the water from the fountain was tested and found free of bacterial contamination.  Camper-staff were advised to run the water every morning to clear stagnant water from the pipes.

Baum (17-24) potability test results received: secondary health standard (pH) exceeded. The Board took note of ZBA guesthouse approval granted on 7/28/2010.    

Fenner (19-11.2)   The Board noted a plan submitted by Chris Alley showing that two separate septic systems are feasible on the property; the Board noted, however, that the ZBA had not yet reviewed the proposal, and that, although at 7.34 + acres, the lot is large enough to accommodate two dwellings, they would have to be located on separable 3-acre sites, or, alternatively, a guesthouse approval would be required from the ZBA.  The Board asked Marina Lent to inform the ZBA of its determination that two separate, fully-compliant systems are feasible on the property.  The Board will take up this proposal following ZBA consideration.

Freedman (25-127)  Marina Lent confirmed after listening to the recording of the BOH meeting of 6/16/2010 that, although the Board had mentioned the desirability of having a de-nitrifying system within the Chilmark Pond watershed, this was not listed among the conditions for final approval of the proposed disposal system construction plan.  The Board asked Marina Lent to draft a letter to the owner conveying the wish of the Board that the owner consider installing a de-nitrifying system in this environmentally sensitive area.

Leonardi (13-43.5) as-built received, certificate of compliance issued.

Abeja Real Estate Nominee Trust (33-123) as-built received, certificate of compliance issued.

Siegel, 30 Osprey Lane (25-121) O&M report for Bioclere inspection received; operator reports being unable to find d-box and tank and requests as-built plan; Marina Lent will ask Schofield, Barbini & Hoehn to supply an as-built plan.

Krause, 22 Tilton Cove Way (29-23) O&M report for Bioclere inspection received; no apparent problems noted.

Rissman, 3 Elliot Ave, (33-21)  O&M report for Bioclere inspection received; no apparent problems noted.

Food Establishment Inspections:  All Island Seafood, Larsen’s Fish Market

Draft Vineyard Model Right to Farm By-law and Draft MV Ag Commission Proposal: The Board received a proposal for a Right-to-Farm By-law and draft MV Agricultural Commission submitted by Christine Flynn of the Martha’s Vineyard Commission.

Mobile Poultry Processing Unit Inspections:  Marina Lent reported on inspections of the newly-licenced mobile poultry processing trailer operating at North Tabor Farm on July 31, and an inspection at Flat Point Farm in West Tisbury by State Inspector Steven Rice on July 29th.

Chilmark Tavern Restaurant cease and desist order issued for pollution of wetland with liquid food waste.  Marina Lent will follow up to ensure compliance.

Regulation Revision:   The Board requested Marina Lent to begin drafting BOH regulations with respect to Title 5 flow requirements.

Water Treatment Operator course: Marina Lent reported that the course is very demanding and may require adjustment in hours.  Alternatively, she asked whether the Board would be willing to hire food inspector Barney Suman for a few food establishment inspections in August.  Mike Renahan stated that the food inspections are a more important priority than the water treatment operator certification.  He also stated that water operator duties could be hired out, as they are currently.  

Foundations for Local Public Health  The Foundations for Local Public Health is an overview course to be held in the fall in Dennis, MA.  The Department of Public Health recommends that at least one Board members and any new staff of local boards attend this course.  

Good Agricultural Practices:  A day-long course on food safety, focusing on farm-based and transport food safety will be held at a time to be determined in the fall.  Jan Buhrman expressed a strong interest in attending.  

Certified Professional-Food Safety  Marina Lent expressed interest in attending a course in 2011 through the National Environmental Health Association (NEHA) that would provide a foundation for high-quality food inspections in Chilmark.

Soil Evaluator Exam passed—awaiting certification card

Invoices  Payment of the following invoices was approved by the Board:
·       Chlorine, Quaternary Ammonium and pH test strips -- $14.50 plus shipping/handling
·       MVRD SEMASS-MSW, Transportation/ transportation recycling  $3,833.95
